KVKK Disclosure Notice

This disclosure notice, prepared under Turkish KVKK Law No. 6698, describes the type, purpose and legal basis of the personal data processed during use of the software, interface and user account provided by EasyCentral LLC, together with the rights of the data subject.

This is an unofficial English courtesy translation. The Turkish KVKK Disclosure Notice prevails in case of any conflict between the two language versions.

A.Scope

This disclosure notice has been prepared by EASYCENTRAL LLC and its representative in Turkey, in the capacity of data controller, under article 10 of Turkish KVKK Law No. 6698 and the Communiqué on the Procedures and Principles to be Followed in Fulfilling the Disclosure Obligation.

Some of your personal data is collected so that EASYCENTRAL LLC can fulfill — completely and in accordance with the relevant agreement(s) — the obligation to make available the products it offers for a fee.

B.Personal Data Processed

B.1.
User Account Data:To associate the software it provides with the user, EASYCENTRAL LLC collects the user's first name, last name, email address, the password chosen for the user account and phone number; that association is performed via this data. The agreement between EASYCENTRAL LLC and the user who will benefit from the offered product is concluded through a public offer (proposal of agreement) made by EASYCENTRAL LLC. Accordingly, EASYCENTRAL LLC is initially in a position where it does not know the identity of the contracting party.

Therefore, this data processing is performed pursuant to article 5/2-c of KVKK Law No. 6698 for the purpose of properly making the software available. In other words, it is necessary for the formation of the SOFTWARE USE AGREEMENT and so that EASYCENTRAL LLC can be sure it performs its obligations to the correct person.
B.2.
Software Telemetry Data:EASYCENTRAL LLC also accesses additional data — limited to operational necessity — to track license usage, prevent unlicensed use, make improvements and enhancements, and to verify, activate or terminate licenses. Not all of this data qualifies as personal data, and although it is disclosed to you under the SOFTWARE USE AGREEMENT, we wish to reiterate certain aspects of this collection here for your information.

EASYCENTRAL LLC can automatically access, monitor, log and process — for license validation or statistical purposes — information about the software installed at the user, the hardware it is installed on, the product ID, modules, used or unused functions, and configuration details.

C.Data Transfer and Your Rights

Data under B.1 is collected directly from you, the user, when creating your account; data under B.2 is collected via the software and/or interfaces. Both processing activities are based on article 5/2-cof KVKK Law No. 6698 — "processing of personal data of the parties to a contract is necessary, provided that it is directly related to the establishment or performance of that contract" — and are carried out by automated means.

Such personal data may be transferred to judicial authorities or relevant law-enforcement bodies upon request, in connection with the resolution of legal disputes or as required by applicable legislation.

Pursuant to article 11 of the Law, which regulates the rights of the data subject, your rights are as follows. Any person may apply to the data controller and request to:

  1. a)learn whether their personal data is being processed,
  2. b)request information if their personal data has been processed,
  3. c)learn the purpose of processing and whether the data is used in line with that purpose,
  4. ç)know the third parties — domestic or foreign — to whom the personal data is transferred,
  5. d)request the correction of personal data that has been processed incompletely or inaccurately,
  6. e)request the deletion or destruction of personal data under the conditions in article 7,
  7. f)request notification of the actions taken under (d) and (e) to the third parties to whom the data was transferred,
  8. g)object to a result adverse to the person arising from analysis of the processed data exclusively by automated systems,
  9. ğ)demand compensation for damages incurred as a result of unlawful processing of their personal data.
